Community order for man who targeted 13-year-old girl online

The girl refused at first to send the pictures but Kyle Shaw, acting under a false name and pretending to be 14, told her it was a normal thing to do.

Later, still under the bogus name, he suggested a new boyfriend for her, someone he knew with the name of Kyle Shaw.

Returning to the dock at Dunfermline Sheriff Court for sentencing was Shaw (20), of Hatton Green, Glenrothes.

He previously admitted that on various occasions between December 14, 2014 and February 8, 2015 he intentionally sent a sexual written communication to a girl aged 13 and intentionally caused her to look at a sexual image by sending her pictures of naked males.

He further admitted that between December 20, 2014 and May 10, 2015 he was in possession of indecent images of a child.

Depute fiscal Azrah Yousaf previously told the court that Shaw set up a false Facebook profile under the name of ‘Callum McEwan’ and sent a friend request to the girl which was accepted.

The girl told him she was 13 and Shaw, under the false name, claimed to be 14.

Their online conversations became sexual and Shaw asked her to send naked photos of herself to him and said that this was “normal”.

The girl refused to do so but Shaw continued to ask and said he would “talk her through this”.

However, she had concerns over whether she could trust him.

The girl did eventually send over photographs of herself in underwear. However, she later sent a message to him saying she wanted to meet him to make sure he was a real person.

This did not take place but Shaw’s requests became more detailed and the girl sent a picture of her private parts to him.

Then the girl contacted him saying her mother had checked her phone. He said, “What do you think your parents would say if you started talking to a 19-year- old?”

He said he would help find her a boyfriend and told her there was someone he knew called Kyle Shaw.

He later contacted the girl under his false name and asked her about “becoming intimate with Kyle Shaw”.

In February 2015, Shaw failed to turn up for a meeting the girl had arranged with him.

Shaw’s behaviour was eventually uncovered by the girl’s mother.

Sheriff Craig McSherry imposed a community payback order with two years’ supervision and 160 hours of unpaid work.
