Court fine and ban for driver in Kirkcaldy

A man who was caught driving while under the influence of alcohol on a Kirkcaldy road but failed to provide a breath test has been fined £500 and disqualified for 12 months.

Brian Robertson, of St Aethans Close, Elgin, appeared before Sheriff Jamie Gilchrist at Kirkcaldy Sheriff Court.

Robertson, 32, admitted on April 28 this year at Kirkcaldy Police Station he failed to provide two specimens of breath for analysis – these specimens were required to ascertain his ability to drive or the proportion of alcohol in his breath at the time he was driving a motor vehicle on Abbotshall Road in Kirkcaldy.

The court heard the accused was stopped by police at 11pm on the day in question and had failed a roadside breath test. He had then been taken to Kirkcaldy Police Station where he failed to provide two specimens of breath for analysis.

Robertson was fined £500 and disqualified for 12 months.
