The Procurator Fiscal Depute told the court the complainer and the accused are in a relationship together and the complainer wasn’t very happy about the accused’s alcohol consumption on the evening in question.

The Procurator Fiscal Depute said the accused kicked a bottle of vodka causing it to smash: “Neighbours heard the smash and they heard the complainer crying. They were concerned about the disturbance so they contacted the police.

"When officers attended they saw the smashed bottle and they saw the complainer was distressed. The complainer said the accused has had issues with alcohol consumption over the past couple of years and that she was fearful of the accused’s conduct once alcohol is involved.”

Hynd’s defence agent said there was hope the relationship would reconcile but he said as far as his client was concerned, his perception is he has no issues with alcohol. He said the argument had started as the complainer was unhappy with him drinking a lot of alcohol on a Sunday.

Sheriff Williamson continued the case for six weeks for Hynd to be of good behaviour and deferred sentence until December 14.
