Fife man who failed to provide a breath test fined and banned

A Leven man who failed to provide a breath test to police has been fined £200 and disqualified from driving for two years.

Gary Anderson, of Glebe Street, appeared before Sheriff James Williamson at Kirkcaldy Sheriff Court.

Anderson, 55, admitted that on October 24 this year at Kirkcaldy Police Station he failed, without reasonable excuse, to provide two specimens of breath which were required to ascertain his ability to drive or the proportion of alcohol in his breath at the time he was driving a car on Anderson Street in Leven.

The Procurator Fiscal Depute told the court a witness saw the accused walking towards his car, observed that he appeared unsteady on his feet as if he had been drinking alcohol. Police were contacted.

Anderson’s defence agent told the court the accused’s marriage had broken down and that he had gone on a downward spiral.

Sheriff Williamson disqualified him for two years and ordered him to pay a £200 fine.
