Fine and ban for Kirkcaldy woman on drug-driving charge

A Kirkcaldy woman who admitted driving with a drug in her system has been fined £240 and disqualified from driving for 14 months.

Jimaine McCallum, of Blyth Street, appeared before Sheriff Alistair Thornton at Kirkcaldy Sheriff Court.

McCallum, 38, admitted that on February 8, 2020 on Blairmore Road, Kirkcaldy she drove a motor vehicle when the proportion of Delta-9-Tetrahydrocannabinol in her blood was seven microgrammes, exceeding the specified limit of two microgrammes, contrary to the Road Traffic Act 1988.

The Procurator Fiscal Depute told the court: “Police officers were in an unmarked police vehicle when they observed the vehicle being driven in excess of 25mph on Blairmore Road. They stopped the vehicle and observed a strong smell of cannabis.

"At 1.45pm a drug test was carried out on the accused which came back positive for cannabis. She was over the prescribed limit.”

McCallum’s defence agent told the court his client pleaded guilty at an early stage: “She is 38 years of age and is a single parent.”He added: “She isn’t working at present and is on Univeral Credit.

"She would be in a position to pay a fine at the rate of £20 per month.”

Sheriff Thornton told McCallum he would be prepared to deal with the matter by way of a financial penalty. He said the fine would have been £360 but due to her pleading guilty at an early opportunity he reduced it to £240. He also disqualified her from driving for a period of 14 months.
