Glenrothes man who breached bail conditions jailed for three months

A Glenrothes man who admitted breaching his bail conditions has been sentenced to three months in jail.

Gary Newton appeared before Sheriff Alistair Thornton at Kirkcaldy Sheriff Court via video link from prison.

Newton, 27, admitted that having been granted bail on May 19, 2020 on the condition that he did not enter Balmaise in Leven and did not approach or contact Kayleigh Beckett, failed to comply as he was found in the back garden of Balmaise, Leven on October 16, 2020.

The Procurator Fiscal Depute told the court: “Neighbours became aware of shouting from the back garden and when they looked out the window they saw Miss Beckett going towards the back garden followed by the accused. The man left and Miss Beckett returned to the address. Police were contacted.

"Efforts were made to trace the accused, but he refused to engage with police officers and would not tell them where he was.”

Newton’s defence agent said that his client had left the garden first and Miss Beckett had followed him out.

He said: “He indicates the relationship has an ongoing status. Bail was put in place by the court and, at the end of the day he went against the court and has to acknowledge that.”

He added that his client, who is currently serving time in prison, was likely to be there for some time to come.

Sheriff Thornton said he had heard what Newton’s lawyer had said on his behalf and taking his current circumstances into account, he imposed a three month custodial sentence and placed him on a 12-month non-harassment order.
