Payback order for Kirkcaldy man had cannabis, and smashed window

A Kirkcaldy man who admitted smashing a window and having cannabis has been sentenced to a two-year Community Payback Order.

David Lockhart, of Harriet Street, Kirkcaldy appeared before Sheriff James Williamson at Kirkcaldy Sheriff Court.

Lockhart, 46, admitted on May 12, 2021 at his home address he wilfully or recklessly destroyed or damaged property belonging to another and smashed a window. On the same date and in the same place, he admitted having cannabis, a class B drug, in his possession contrary to the Misuse of Drugs Act 1971.

The Procurator Fiscal Depute told the court: “The witness and the accused have been in a relationship for 15 years and had been residing together. On the date in question the accused and the witness were at the address having drinks.

"The accused left to get some food for dinner.

"He did not return and the witness went to bed.

“He came back after midnight ,and the complainer heard him knocking at the back door, shouting to be let in. She ignored this.

"He banged on the door – this went on for several hours. At 5.45am the complainer observed the glass in the back door had been smashed and the accused was still outside. Police were contacted.”

She said the accused was searched and the cannabis was seized.

Lockhart’s defence lawyer said his client has struggled with excessive alcohol consumption for some time which affects his behaviour.

Sheriff Williamson placed him under supervision for two years on a Community Payback Order and ordered him to undertake the Caledonian Men’s Project as part of the order.
