A man who committed a “manifestly unpleasant” indecent assault on a couple has been ordered to carry out 130 hours of unpaid work.

Buist, of Durward Street, Leven, had previously admitted indecently assaulting the man by kissing him on the mouth, and a second charge of indecently assaulting the woman by seizing her by the head, kissing her on the cheek and trying to kiss her on the mouth.

The incident took place on October 31 last year in the car park at Leven Health Centre.

Kirkcaldy Sheriff Court was told last Thursday the kissing was “unwanted and unexpected” and the victims were “upset and felt violated”.

Sentence had been deferred for a supplementary report.

A depute procurator fiscal said both victims were in the male complainer’s van when the man, who knew Buist, acknowledged him, after which the incident happend.

Buist (63) appeared to be under the influence of alcohol and walked up to the driver’s window, asking: “Have you got a bevvy?” before leaning in and kissing him on the lips.

He went to the passenger side of the vehicle, opened the door and kissed the woman on the cheek as she turned away from him. He took hold of her cheeks and tried to turn her head towards him in an attempt to kiss her on the lips.

The man shouted at him to stop and pushed him away, while the woman managed to close and lock the door.

Buist’s solicitor said the report described the incident as “manifestly unpleasant” and it had occurred after considerable misuse of alcohol.

Sheriff Simon Collins QC imposed a Community Payback Order for 130 hours of unpaid work to be done in six months – telling Buist it was an alternative to prison – and placing him on the Sex Offenders’ Register.
